QUESTION 6: What You Need To Understand Before Voting on this Abortion Ballot Issue
Ballot Question 6 related to abortion rights in our Nevada Midterm Election. What are the implications on this issue that affects women’s right to bodily autonomy?

This November 3 the midterm elections are once again taking place and voters will have a chance to decide on local and state issues here in Nevada. This year, ballot question 6 has already created buzz. But what does voting yes or no on Question 6 mean for Nevada and our community?
“Yes” on Question 6: Supports adding the right to an abortion in our Nevada State Constitution until the point of fetal viability (22-24 weeks), or to protect the life or health of the pregnant woman
“No” on Question 6: Opposes adding the right to an abortion in our Nevada State Constitution until the point of fetal viability (22-24 weeks), or to protect the life or health of the pregnant woman
If Question 6 sounds familiar to some Nevadans it’s because many may have already voted on this issue in 2024. In order for the right to an abortion to be enshrined in our constitution, voters have to pass it in two consecutive voting terms by the last election’s percentage of 64%.
Since the overturning of Roe v. Wade and the enactment of the Dobbs v. Jackson Women’s Health Organization decision in 2022, abortion rights are now decided by each state. Adding this option in the Nevada Constitution would protect Nevadans from federal overreach.
To clarify, fetal viability is when the fetus can survive outside of the womb; this cut off point would typically be during the 22-24 weeks of pregnancy. Also if the pregnant woman has health complications and is at any risk, an abortion can be legally performed by a qualified license professional.
As for parental consent, in 2019 Governor Steve Sisolak signed the Trust Nevada Women Act or Senate Bill 179 that expanded abortion rights. This allowed there to be no need for parental notification when receiving an abortion.
If Question 6 does not pass, abortions will still be legal in Nevada, including for minors who do not need to inform their parents or receive approval from a judge.
Nevada also allows non-residents of Nevada to receive safe access to an abortion, either medicinal or surgical.
